These Merchant Terms & Policies govern the use of the ELNET ISP Billing and Management Platform by hotspot businesses, operators, administrators, and other merchants using the platform to manage internet hotspot services, customers, packages, vouchers, payments, and related services.
By registering for, accessing, or using the platform, the merchant confirms that they have read, understood, and agreed to these terms and policies.
ELNET refers to ELNET-Technologies and the technology platform providing isp billing, management, authentication, payment integration, reporting, and related services.
Merchant refers to the individual, business, organization, or hotspot operator using the platform to provide internet access services to customers.
Customer refers to an end user purchasing or using internet access services provided by the merchant.
Platform refers to the ELNET ISP Billing and Management System, including its web application, billing tools, authentication services, payment integrations, reporting tools, APIs, and related services.
The merchant must provide accurate, complete, and current information when creating an account.
The merchant is responsible for maintaining the accuracy of their account information and must update information when necessary.
Each merchant must maintain the confidentiality of their login credentials and is responsible for activity performed through their account.
Merchant accounts must not be created using false identities, misleading information, or information belonging to another person or organization without authorization.
ELNET may require additional information or verification where reasonably necessary for account security, platform operation, payment processing, compliance, or fraud prevention.
The merchant is responsible for the internet access service offered to its customers, including the network equipment, internet connectivity, hotspot locations, packages, prices, customer communications, and applicable operating requirements.
The merchant is responsible for configuring and maintaining its routers, access points, NAS devices, internet connection, and other network infrastructure required to provide hotspot services.
The merchant must ensure that its use of the platform and the internet services it provides comply with applicable laws, regulations, telecommunications requirements, and other lawful obligations.
The merchant must not use the platform to facilitate unlawful activity, fraud, unauthorized access, abuse of network services, or activities that may harm ELNET, payment providers, network operators, or other users.
The merchant is responsible for protecting access to its administrator account, payment credentials, API credentials, router credentials, and other sensitive configuration information.
The merchant is the provider of the internet access service purchased by its customers. ELNET provides technology used by the merchant to manage billing, authentication, vouchers, payments, and related operations.
The merchant is responsible for clearly communicating its package prices, service duration, access conditions, limitations, and applicable customer policies.
ELNET does not guarantee the availability, speed, quality, or uninterrupted operation of the merchant's internet connection. Internet service availability may depend on the merchant's ISP, network infrastructure, power supply, equipment, and other external factors.
Where applicable, the merchant may be required to maintain an active platform subscription in order to continue using paid platform services.
Subscription plans, prices, durations, and available payment methods are determined by ELNET and may be displayed through the platform.
A merchant subscription becomes active after the applicable payment has been successfully confirmed by the platform or otherwise approved through an authorized payment process.
The merchant is responsible for ensuring that subscription payments are made using valid and authorized payment methods.
ELNET may restrict or suspend access to platform features when a merchant subscription expires, remains unpaid, is cancelled, or becomes subject to a legitimate account or security restriction.
Payments made by hotspot customers for internet packages are payments for the merchant's internet access service. The merchant remains responsible for the service sold to those customers.
The platform may integrate with third-party payment service providers and payment gateways.
Payment transactions may be subject to the terms, fees, limits, verification requirements, processing times, and technical requirements of the applicable payment provider.
ELNET is not responsible for delays, failures, reversals, outages, or restrictions caused by a third-party payment provider where such issue is outside ELNET's reasonable control.
Merchants must provide accurate payment configuration information where the platform requires merchant-specific payment credentials or account information.
Merchants must not use payment credentials belonging to another person or business without proper authorization.
The merchant is responsible for establishing and communicating its customer refund policy for internet access packages sold through its hotspot service, subject to applicable law and the requirements of the relevant payment provider.
ELNET does not automatically guarantee refunds for internet packages purchased from a merchant. Refund requests concerning a merchant's internet service should normally be directed to the merchant.
Where a payment was processed through a third-party payment provider, any refund may also be subject to that provider's transaction and refund procedures.
Platform subscription payments made by merchants are generally non-refundable once the subscription period has commenced, except where a refund is required by applicable law or expressly approved by ELNET.
Nothing in this section limits any mandatory consumer or merchant rights provided by applicable law.
The platform may process information required to provide billing, authentication, account management, payment processing, reporting, security, and other platform functions.
Depending on how the platform is configured, information processed may include merchant account information, administrator information, customer identifiers, telephone numbers, voucher information, transaction information, network identifiers, authentication records, usage records, and technical information.
The merchant is responsible for using customer information only for legitimate purposes connected with providing and managing its services and for complying with applicable privacy and data protection requirements.
The merchant must take reasonable steps to prevent unauthorized access to customer information and must protect account credentials, payment information, API credentials, and other sensitive data.
ELNET may process platform data for purposes including service delivery, security, troubleshooting, billing, reporting, fraud prevention, system administration, and improvement of the platform, subject to applicable law and the platform's privacy practices.
The merchant must not use the platform to conduct or facilitate illegal, fraudulent, abusive, deceptive, or unauthorized activities.
The merchant must not attempt to gain unauthorized access to the platform, its servers, databases, payment systems, authentication systems, or other users' accounts.
The merchant must not intentionally interfere with the operation, availability, security, or integrity of the platform.
The merchant must not use the platform to distribute malicious software, conduct unauthorized attacks, or otherwise misuse network or computing resources.
ELNET will make reasonable efforts to maintain the availability and operation of the platform. However, temporary interruptions may occur because of maintenance, upgrades, technical failures, connectivity problems, security incidents, third-party service failures, or other circumstances beyond reasonable control.
ELNET does not guarantee uninterrupted or error-free operation of every platform feature at all times.
Merchants must immediately report suspected unauthorized access, compromised credentials, suspicious payment activity, or other security incidents affecting their account.
ELNET may temporarily restrict account access where reasonably necessary to protect the platform, the merchant, customers, payment systems, or other users.
The merchant may stop using the platform at any time, subject to any outstanding payment obligations or applicable contractual requirements.
ELNET may suspend or restrict a merchant account where there is reasonable evidence of fraud, abuse, unauthorized access, security risk, unlawful activity, violation of these terms, misuse of payment services, or non-payment of applicable platform subscription fees.
ELNET may terminate an account where a material violation of these terms occurs or where continued operation of the account presents a significant legal, security, financial, or operational risk.
Where reasonably practicable, ELNET may provide notice before suspension or termination. Immediate action may be taken where necessary to protect users, systems, payment services, or comply with legal or security requirements.
Termination or suspension does not remove obligations or liabilities that arose before the effective date of suspension or termination.
ELNET may update these Merchant Terms & Policies when necessary to reflect changes to the platform, services, payment methods, security requirements, legal requirements, or business operations.
Each published version is identified by a version number or date. Where a new version becomes effective, the updated version will be made available through the platform.
ELNET provides the billing and management technology used by the merchant but does not operate the merchant's internet network on the merchant's behalf unless a separate service agreement states otherwise.
The merchant remains responsible for its internet connectivity, network equipment, customer service, package configuration, customer-facing policies, and compliance with applicable laws.
Merchants may contact ELNET through the support channels provided through the platform or the official ELNET contact information.
For matters concerning a customer's purchased internet package, service quality, or merchant-specific refund request, the customer should first contact the merchant providing the hotspot service.
By creating a merchant account and accepting these Merchant Terms & Policies, the merchant confirms that the information provided during registration is accurate and that the merchant agrees to comply with the applicable terms and policies governing use of the platform.
